What kind of personal information does NuGen collect?

NuGen guarantees that during the it (i) shall keep the Confidential Information confidential and shall not directly or indirectly, use, divulge, publish or otherwise disclose or allow to be disclosed any aspect of Confidential Information; (ii) shall refrain from any action or conduct which might reasonably or foreseeably be expected to compromise the confidentiality or proprietary nature of the Confidential Information; and (iv) shall use the Confidential Information solely for the performance of its Services.
Limitation - NuGen shall have no obligation to maintain in confidence any information that (i) is in the public domain at the time of disclosure, (ii) though originally Confidential Information, subsequently enters the public domain other than by breach of NuGen's obligations hereunder or by breach of another person’s or entity’s confidentiality obligations, or (iii) is shown by documentary dated evidence to have been known NuGen by the Service Provider prior to disclosure to it by the user.
Proprietary Rights - Confidential Information, Confidential Materials and Works (as defined below) uploaded by the user shall be and remain the sole and exclusive property of the User. For purposes of this Agreement, the term “Works” shall mean all generated code and deliverables to the user together with all patent, copyright, trademark, trade secret, mask work, and other intellectual property rights in any of the foregoing, whether or not capable of being patented or copyrighted or protectable as trade secrets.
Waiver of IP Claims and Moral Rights - NuGen confirms and undertakes that it does not have at present, and that it will abstain from commencing any law suit or claim against the User with regards to the Works, including claims with regards to ownership and/or infringement of the Works, that such are the property of the User.
